New claim or EUC
I was layed off last November 16th of 2012. I started June 1st 2012. Before I got the job, I was on EUC from my last claim.
I was getting 415 a week on that claim.
When I was let go of my last job, TWC said I would get 222.00 a week, but noticed that I still had a open claim that I was collecting on from before I got the job, so awarded me the 415 a week.
I am trying to understand the benefit quarters that TWC looks at to ascertain benefit weekly amount. I think the next quarter ends JAN 5 2013.
TWC does not look at the current quarter, nor the quarter immediate before.
What I am asking is, if I do not find a job before my EUC ends ( hopefully congress extends ) before March, will I be eligible for a higher amount on a regular state UI claim?
I was previously awarded $222.00 a week.. but they were looking at the current quarters..
I made $65,000.00 a year for only 6 months. So, if I am looking at this correctly,
October , November December 2011 = 0.00
Jan , Feb, march = 0.00
april, may, june = 5000.00 for quarter
july, aug sept = 15000.00 for quarter
using this data, I qualify for 440 a week.
My big question is, if I exhaust EUC, and need to start a new claim this march 2013, will they calculate my weekly benefit amount using the data they used last November 2012, or will they re-crunch the numbers in march.
I hope I make sense.

Keep your fingers crossed that the House does pass the extension tomorrow, it is still up in the air.
If they do, and you are eligible for extended benefits through March, the 4th quarter (thru 12/31/12) should be used to calculate your new benefit amount. Employers have until Jan. 31, 2013 to provide wage reports to the state, then the state must update their data. It should be taken care of by March, but it is no guarantee.

I called in today to setup my last payment request. I have only 136.00 remaining on my tiers. Now, I was asking about my regular claim that paid 222.00 a week, and asked if they would be using the same quarters to find out what my Weekly Benefit Amount would be.. they said that would not change.
Is this true? I thought since Ity has been more than 3 months, and that they would be re-running my claim, that they would be using the new quarters data.. but he said they would be using the same..
I hope I am making sense.

I thought they made a law against this practice back a few years ago. Call your US Congressman to find out. This is not right. If you worked for at least 20 weeks you should get the new rate, once your extended benefits are done. You should get at least 20 weeks. Visit your state website.gov and check the laws.

Just called back this morning.
Turns out that they are back dating my claim.
They call me an Option A.
When I lost my job last November, I let TWC know. I filed a claim, then they found that I still had a balance on an older claim. I had to exhaust that older claims TIERS first before moving to my current new claim.
They ran my quarters income, and said since I was eligibile for more on my last claim, that I would be using that.
I just exhausted my EUC this month, so I was thinking good, they will re-crunch my numbers and quarterly earnings again.. but they didnt.. they just used the data they had when they made the determination last November, which is 222.00 a week. If TWC used the new quarters

I think they are using these quarters.. which is what they were WHEN I APPLIED LAST NOVEMBER
