Can One State 's Employment Dept. Garnish ANOTHER State's Unemployment Benefits For An Overpayment?
The state of Oregon filed a overpayment judgement from my unemployment benefits in 2012. I've appealed, but for now it is vailid. I now live in Illinois and was employed for all of 2013 before being recently terminated.
Now Illinois is allowing 25% of my unemployment benefits to be paid to Oregon. How does this happen? I've challenged the Oregon garnishment, but if unemployment benefits are supposed to exempt from garnishment (unless in the case of child support) why does Illinois allow this?
Again-I don' t owe Illinois, I owe Oregon. Can anyone help with this?

I don't know if they can or can't. That's a question that maybe the administrators can answer. My guess is that they can. However, if you can furnish supporting documents that you don't owe Oregon a dime, then the matter is settled and you don't owe them anything.

Those of us that have been through it all have been force to live with our new existence. We no longer have the will or strength to fight for something we know will never happen

Mike89, this forum was vibrant. Where were you? I suppose like everyone else, sitting back and letting a handful of members do all the work. Sorry, we got tired and our spirit broken.
Yes, Oregon has the right to garnish your benefits. All the $$ for it comes from a federal source.
