First off sorry to hear that. Yiu should of been given the opportunity to contest. Same thing happened to me when I was first on. It took 2 months to resolve. I wish you the best.

As Elvis said, file an appeal. They have to act on that. I found this link to a guide to legal aid for unemployment claims. Perhaps it can give you some information that could lead you to a next step.

Definitely file an Appeal before your time runs out! If you can't get help, call your Congressman and Senators. Contact an Unemployment Lawyer, they know the law better then everyone. A simple call from them, might all you need.

Agencies are known to lie. If you did not sign anything. Then they must prove it.

File a claim directly with the Massachusetts Board of Labor.

Also, don't be rude to these people - they will help you, because most are aware how deceitful the temp agencies are. Be polite and above all have your information available so that you aren't wasting their time - currently, they are overwhelmed with appeals. There are some who are plainly convinced that the unemployed are the problem - be civil, because they have far more power than you. We've been scapegoated by the news media - now WE are considered unskilled and too lazy to find a job.

Thank you for all the replies! I couldn't exactly appeal b/c I hadn't been denied yet. I was just sitting in limbo, waiting for them to take my statement so they could then make their decision. I agree wholeheartedly about the temp agencies and their devious ways! As a matter of fact, I believe the reason my "assignment had ended" was b/c I complained to them too much about missing wages, an entire week of pay. They eventually did send me that missing week of pay, but neglected to pay me my last 2 days of work there. I am also waiting on a decision from the Fair Labor Division on that as well.

Last week, I sent and faxed letters to both the adjuster and the Executive office of unemployment. The next day, I did receive a call from a very nice, sympathetic woman in the Exec. office. She assured me that I would receive a call from the adjuster today. Well, lo and behold I did receive a call from the adjuster today. Let's say she wasn't exactly pleased that I tried to involve others. I found her to be rude and impatient with me. She took my statement, then informed me that the the agency hadn't responded to her request for information. She then told me she is approving my claim, but the agency may appeal it and then there would need to be a hearing. She wasn't exactly forthcoming with answers to my questions. Does this mean I will be paid retroactively for all the weeks I have been claiming?

This is awful, I'm hearing more an more stories about employees being treated horribly....it's becoming too common because they think they can get away with it now more than ever, I believe they are taking advantage of desperate unemployed people. They think because it's so bad out there that either people will put up with it because they fear being unemployed again or that they can have their pick of employees because there are so many out of work.

I'm so sorry they did that to you, keep up the fight until you get compensated for the work!!! Sorry for going on and on but this is really becoming too common and people have been through a lot. Searching and praying and hoping for some type of job, any type of job really, only to get hired and treated like crap. Good luck to you and please keep us updated if you can.

Unfortunately, the Agency can appeal your approval for UI. Depending on their management, this may be something they are doing on a regular basis. If this happens, you will get to attend the hearing and you can bring another person with you to represent you regarding the facts of the case, or somewhat who has knowledge regarding the facts. Don't be too upset about this hearing, it is set up to tell both sides of the story. However, if it is determined that you were not entitled to the UI, then the State can ask you to repay the weeks that you have received up until the decision was made against you. And, just so you know, this amount can be forgiven by the State, or they can place a lein against you and hope that when you return to work, it can be repaid. Sometimes, they will lein against your State income tax return, if you have one coming to you. All of this is stressful, but it is rare that the State asks you to repay the amount. Remember, it was approved by one of their people to begin with. Hope this helps. Hang in there, your not the first person to go through this. And, as S&T said, this sort of crap is happening all over the place these days.

The problem with a hearing, it can take months. In Ohio, in 2006, I waited 9 months for my hearing. With that much money to lose I did get an Unemployment Lawyer who knew the law. I did win, it cost me $500. My retroactive Unemployment check was close to $9,000. This was a fight with a lying agency. Fortunately I had a savings to cover my family. That was for the standard 26 weeks.

I don't mean tgo scare you. These things can take months. but then it depends on your state. You already lost more then 2 months in payments, that is the breaking point to get a lawyer involved!
