EDD lied to me, do I have recourse? & FED ED question
So in November 2009 I opened a claim. I recieved the top amount weekly, $450. In Novemnber 2010, edd automatically refiled a new claim, suddenly making my weekly benefit amount $80 instead of the $450 I had been receiving. I wrote stating there was a new law that if the difference was greater than $100, I was could stay on extended benefits. They responded that I was out of extended benefits so I had to take the new claim.
$80 does not help anyone so I cancelled this claim. I ended up getting a temporary job and was able to refile 6 months later and recieve $448 a week but for only 17 weeks which meant I could not receive any extended benefits. After the 17 weeks ran out, suddenly I was on tier 4 from the LAST claim that they told me had been exhausted. I asked if I could then file for FED ED but was told no as a new claim had been opened.
Had they not told me last November that I had exhausted my entire extension, I would have been on tier 4 and then FED ED instead of moving to a tiny claim and subsequently cancelling it and having no income for 6 months. I feel like I've been lied to or at least had a bait and switch pulled on me. Do I have any recourse? Can I appeal saying they told me I had exhausted my benefits last November when I haden't? It seems unfair that working and starting a new claim discludes you from receiving FED ED, when they put you back on your past extensions to being with! Any help would keep my from wanting to vomit over this. Thank you .

Each state does have an appeal process Wendyrite. I don't know what state you are in, however, you can request an appeal by contacting your uc center and asking for the appropriate paperwork to file. It's not a quick process, and with the many new laws enacted, I don't know what your chances may be, but it's definitely worth taking the time to fill out the paperwork and make a claim.

Go to your State Unemployment Website. Found out the rules yourself. Then compare the rules word for word on your history. At the time of each extension there was confusion in each state. They had to do major computer work and claims were messed up for weeks. This was especially bad in California, from what I remember.
I would call and ask to speak to a manager, not just some clerk. In Ohio I was told conflicting information and in other state too. California was really screwed up by remembering terrible stories on Unemployed Friends Friends, the original forum.
You have a right to appeal, provided the time never run out. I know they can come after you if you did wrong years later. I would contact at least my Congressman and 2 Senators for help if nothing can't be investigated.

Thank you for that, I'm in California. I hope i can appeal from a year ago. I had no idea until I started getting a tier 4 recently.
