Hello all,

I am new to this forum and find it full of information. I'm so happy there is a state-by-state breakdown. Here is a bit of information regarding my situation.

I was laid off from a position in a call center for a major insurance company in Albany, NY, on April 10, 2013. Human Capital Management informed me that my dismissal was for "failure to perform and reach productivity expectations based on company policies, during the 8 week adjustment period". They have agreed to pay unemployment benefits.

After the initial shock wore off, I signed up for college at Hudson Valley Community College in Troy, NY, to get a certificate in Bio-technoloy and Semi-conductor nano-science. There is an increase in job opportunities for both. Each certificate is 2 semesters. With my background in science, I was accepted into the programs immediately for this coming Fall 2013!

I have voluntarily been to the NYDOL and have signed up for the many free Continuing Education Courses, as well as filled out the 599 form, that if approved, will allow me to collect benefits without having to look for a job. I plan to spend the summer learning from the free workshops at the Career Center and have made a valant effort to let the staff there know how serious of a student I will be, and how dedicated I am to succeeding, as I have not been out of work since I was 16. I am now 30.
I want to get a summer job at a restaurant and not begin my unemployment payouts until school begins in fall. Wi this a possibility? What are the rules on that? Any additional information would be great! I can't be unemployed all summer! I will go crazy, lol, but I do not want to work while I am studying.

Please help, thank you! Sorry if this was long winded, all my friends have jobs and can't talk on the phone during the day :>) lol

Welcome to the forum!

The admins will need to verify this, but I believe you need to file a claim immediately after losing your job, or else your benefits will be delayed or even lost. After filing a claim, there will be a delay of between 1 and 3 weeks before you start receiving your benefits.

You are allowed to work a low-paying or parttime job while receiving unemployment. The unemployment amount you will receive will be reduced, depending on how much the job pays.

I filed on 4/15, and now they are saying that my unpaid waiting week is 4/28. I'm so confused. I'm calling the UI benefits number, 888-209-8124, to get some questions answered. I guess that makes some sense though :>)

I will ask UI the following:

"I was just wondering since I already began the Unemployment application process on 4/15, once approved, would it be okay for me to work part-time, 3 to 4 shifts per week, this summer, make more than $405 and claim as such on the website? Then, when I start college at the end of August 2013, I will work at the restaurant sporadically, or not at all during each semester. At that time, I want to begin claiming unemployment benefits in order to concentrate on my studies.
I won't quit the job at the restaurant, but will make sure that where ever I work, the employer agrees up front to my part-time/per diem situation when school starts. If the restaurant agrees to that situation, then I should be able to begin claiming unemployment benefits each week when I start school right? "

Does each week that I claim I worked 3 or more days, making more that $405, count as 1 of the 26 weeks of unemployment that I am elligible for?"

I'll let you know what I am told!

when your payment amount is determined you are given a lump sum amount. You are usually allowed to keep a percentage of the difference
(as an incentive for working) say u get 100$ benefit and make 50$ working instead of 100$ benefit you would get first the 50$ you earned

then 50$ - (say $20 incentive) equals 30$... take the 100$ - 30$ would equal 70$ benefit so your take home money would be the $50 +$70 benefit to equal $120 total for the week..

your benifit weeks are then extended, as you are drawing on your lump sum at a smaller amount each week...

this info is all on your states website as each state is slightly different, i hope i didnt confuse thing even more for you!

Yeah, it gets a bit complicated when you are collecting and working parttime at the same time. Each period (usually for 2 weeks) you have to fill out a form in order to claim your benefits. One of the questions is, "Did you work during the weeks claimed?" If you did, you have to report your income. They will then determine what, if any unemployment you will receive for that period. If you didn't work during the 2 week period, you will receive full benefits. If you did work, you will receive reduced benefits.
