What are my options...need the experts...please help Empty Can I still collect UC ?

Post by munster05 Sun Aug 07, 2011 9:52 am

I have been out of work in the state of PA since the beginning of April and the good news is I have finally landed a full time job and start tomorrow. The bad news is that it is about 1/2 of what I was making at my old job(35K compared to 60K). I know I should be grateful just to have found employment, but will I still be eligible to collect any PA UC benefits since I still have about 6 weeks left on my original 26 week benefit, then would have been eligible for another 20 weeks of EUC? On my original Notice of Financial Determination it does state " During your claim week if you earn more than $230 but less than $803 you may qualify for partial benefits"

Thanks

Congratulations and good luck on your new job!

Not sure if you are still eligible to collect UI benefits given the amount you will be earning, each state is different. Please contact 1-888-313-8284 and speak directly to a UC Representative.

Holy crap! your earnings limit for a week is $230? LOL, mine was $53. Anything over that I was docked benefits. If you make less that $803 a week you should be able to draw part of your benefit check according what you just quoted. Keep filing and see what happens. Just make sure you DO CLAIM the money you earned.

Let me add to this...just started my new job today at a major mall engraving company and...HOLY CRAP !!! I was a real manager for 10 years where you actually coach and manage people while managing inventory and producing reports and presentations to keep your superiors informed. I went thru the first day training and this is not for me based on my qualifications...I was a Manager of operations of a major health insurer with 10 yrs experience and ZERO experience in sales, now after the first day of training I am informed that I will be expected to do sales, engrave, manage, coach and 50% of the time be at the store by myself and meet quotas based on my area are rarely met...also found out that I rarely will NOT be working a 40 hr work week like the Regional manager Manager outlined with the offer and will be working more like 50 + hrs with 1/2 the pay I was getting with my old job...oh did I mentioned the Regional Manager lied to me and said that the only reason she did not get back to me sooner was because it was an HR Corporate error, but I find out that the real reason was that the person she originally hired lasted one week before she said..."I dont think so...I'm out of here" Since today was my first day....what are my options...can I bow out and rescind my acceptance, then continue to collect UC until I find something in my field, or am I stuck with this job ? [/b] I really don't even think they have me plugged into their HR system yet. I would not have accepted if I know what I know now after the first day that this is not in my field nor could I excel. I received alot more info that what I got over the phone and during the initial initial interview. I have alot of other irons in the fire with other Health Insurers in my field and hope to land there but know this retail job is not for me....at least this one with this company is not.

Please someone help me....I am supposed to report at 1:30pm tomorrow.

Thanks for your help guys, munster

munster, you do have to accept. They can turn you in and you would lose your benefits. Unfortunately it stinks, but it could happen. You should ask for your job description and hours etc in writing. If you are not being paid a salary you will receiving OT for the additional 10 hours.

As far as collecting, I don't know if you would still be eligible, full time work at a certain rate is classified differently than part time work. Generally, full time work does not qualify you for additional funds from unemployment, it is not a supplement to wages. Best for you to call.

I found out that I will not be receiving overtime....anything over 40 hrs I will be paid "chines" overtime which is less that your hourly wage. I am what they call hourly salary....I s there no way since I am not in the system yet and did not have all the facts can reject this offer ?

I was not given the full info by the recruiter before I accepted...I should be able to call PA UC and correct this....especially since I officially am not in their HR system.

Hi Munster, Im sorry about the job being a disappointment. Unfortunately its quite common for HR Managers to lie. I know its hard, but if I were you I would try to stick with it while keeping an eye on other prospects. Half the battle of the unemployed is finding someone to hire us after being unemployed for so long. Now when you fill out applications, you can put that you are currently employed. That may help you get a better position (its not right I know, but its true)

Unfortunately its a decision only you can make. Good luck and I'm sorry you have to go through this. Im not sure about the unemployment benefits.

Munster, I'm no authority, but I always thought that in PA, you are not required to accept work that is less than some percentage of what you were making before, or maybe it's less than you could reasonably expect to make in your field..

Also, there is a fairly generous provision for getting a partial check if what you're getting paid is less that what you would receive on UC. But I always found the calculation less than straighforward.

Both of these are in the UC handbook they sent you and it's also on the web site.

I don't know if any of this helps.

I was also misled that I was going to be able to hire an assistant manager, now I was told that I have only 12 hrs a day of payroll to work with, which virtually means It will be me and one part time person. This was not outlined to me prior nor was the fact that I would be working more than 40 hrs. I was told that if I did work over 40 that would be overtime, which is fine and why I accepted because that would help make up for the difference between making 60 K old job to 30 K at this job, but now I am told that any hours over 40 I will actually get paid LESS than my hourly wage. I am just not sure what to do now....do I rescind my acceptance thencall the PA service center and explain or call the service center first, or just rescind my offer and tell them I no longer wish to accept & just file my claim as normal in 2 weeks. I know I will not be able to handle the hours of this job...I have a family with 3 kids and there is no way I could handle it if I am going to be expected to work 50+ hrs a week and not get paid overtime.
